My gf is an studying in Australia on a student visa and is pregnant?
What should I do that my girlfriend is pregnant? she is an international student on a student visa from Indonesia.

1) improve your grammar! please! 2) I assume you mean she is Indonesian and you live is Australia, and she may have to go back, is that correct? If she is carrying your child then, I believe the law states she can stay with you because of the child and won't be deported. I maybe wrong, feel free to correct me if I am. However if you mean she is leaving to go study in Australia, there is nothing you can do, that is her choice, sorry.

If you are an australian citizen you can marry her and apply for her to get a spouasl visa. BUT she will most probably still have to pay for the birth (hospital and doctors). If you are not an australian legal resident or citizen then the baby will NOT be an australian citizen since both parents are not australian residents or citizens.

If you are an Australian citizen or PR and if you have lived together for 12 months in a genuine relationship or if you marry, she can apply for a spouse visa with you as her sponsor . http://www.immi.gov.au/migrants/family/partner-inside.htm If you can't or don't want to go the spouse visa route, there is very little you can do. She can stay here until the end of her course as long as she continues her studies and meets her student visa conditions, but unless she applies for an immigration visa or another student visa, she will then have to leave the country and having an Aussie baby won't make any difference. If you are on the birth certificate as the acknowledged father of the child (and are a citizen or PR of course), it will be an Australian citizen but that provides no residence or citizenship rights to its Indonesian mother. If you don't want to marry at this time but do want to stay together, the best bet would be for you to qualify for and then apply for a spouse visa by living together for 12 months. Once granted (takes a few months), that will give her access to Medicare and a visa to stay here and work or study. After 2 years, she gets PR if you are still together. If you marry, she will be eligible for Medicare as soon as she applies for her spouse visa.
